1. About Us

Avalon Forestry is a UK forestry plant supply business specialising in the coordination of forestry planting stock for woodland creation projects, commercial forestry operations, and public-sector planting schemes. These Terms and Conditions govern the supply of goods and services by Avalon Forestry to its customers.

2. Quotations and Orders

Unless otherwise stated in writing, all quotations issued by Avalon Forestry remain valid for 30 days from the date of issue, after which they may be subject to revision. All quotations provided by Avalon Forestry are valid for the period stated on the quotation document, or where no period is stated, for 30 days from the date of issue. Quotations are subject to stock availability at the time of order confirmation. All planting stock is offered subject to availability from our network of specialist nursery suppliers. A contract for the supply of goods is formed only upon Avalon Forestry issuing a written order confirmation. We reserve the right to decline or withdraw from any order prior to confirmation.

4. Pricing & Payment Terms

VAT: All prices are quoted exclusive of Value Added Tax (VAT) unless explicitly stated otherwise. VAT will be applied at the statutory rate applicable at the time of invoicing. Price Revisions: Avalon Forestry reserves the right to adjust pricing prior to written order confirmation to account for fluctuations in nursery production costs, currency exchange rates, or unexpected market conditions beyond reasonable control.

4.2 Instalment Payment Schedule

Unless alternative terms are expressly agreed upon in writing, payments for tree seedling orders are structured in three distinct instalments:

First Instalment (Deposit): 33% of the total order value, due immediately upon order confirmation and contract signing.

Second Instalment: 33% of the total order value, due upon official notification that the planting stock is ready for dispatch.

Final Instalment: 34% of the total order value, due within 14 days of delivery.

Note: All payment terms will be formally confirmed in writing within the final order contract. Where bespoke alternative payment arrangements are agreed upon in writing, those terms shall supersede standard provisions.

4.3 Late Payments & Overdue Accounts

In accordance with the Late Payment of Commercial Debts (Interest) Act 1998, Avalon Forestry reserves the right to:

• Charge statutory interest on overdue balances at a rate of 8% above the Bank of England base rate.

• Claim statutory compensation and reasonable costs incurred in the recovery of overdue debts.

5. Role of Avalon Forestry

Where planting stock is supplied through Avalon Forestry’s network of specialist nursery partners, Avalon Forestry will act as the contracting supplier to the customer unless otherwise agreed in writing. This means the customer’s contract is with Avalon Forestry directly, regardless of which nursery partner supplies the stock. Avalon Forestry accepts full responsibility for the fulfilment of orders placed under these Terms & Conditions.

In certain circumstances Avalon Forestry may introduce customers directly to specialist nursery suppliers. Where this occurs, contractual responsibility for the supply of goods will be made clear in writing before any order is confirmed.

Delivery dates are estimates unless specifically agreed in writing. While Avalon Forestry will make every reasonable effort to meet agreed delivery schedules, delays outside our reasonable control may occur. Avalon Forestry accepts no liability for losses arising from delivery delays caused by third-party hauliers, supplier delays, adverse weather conditions, or other circumstances beyond our reasonable control.

6. Delivery

Avalon Forestry shall not be liable for any failure or delay in performing its obligations under a contract where such failure or delay results from events beyond our reasonable control, including but not limited to:

• Severe weather events, including storms, flooding, drought, or extreme frost
• Disease or pest outbreaks affecting nursery stock (including Phytophthora, Ash Dieback, or other notifiable plant diseases)
• Transport or haulage disruption
• Industrial action or strikes
• Government restrictions, regulatory changes, or statutory interventions
• Acts of God, fire, explosion, or natural disaster
• Failure of third-party nursery suppliers due to crop failure or unforeseen production issues

In such circumstances, Avalon Forestry will notify the affected party as soon as reasonably practicable, and both parties will endeavour to agree revised terms where possible. If a force majeure event continues for more than 90 days, either party may terminate the affected contract in writing without liability, subject to settlement of any amounts already due.

7. Force Majeure

Avalon Forestry shall not be liable for any failure or delay in performance arising from events beyond its reasonable control, including but not limited to: severe weather events; disease outbreaks affecting planting stock; transport disruption; industrial action; government restrictions or regulatory changes; and supplier crop failure or nursery stock loss. In the event that a force majeure event continues for a period exceeding 90 days, either party may terminate the affected order in writing without penalty.

Include events such as:

  • Severe weather
  • Flooding
  • Drought
  • Plant disease outbreaks
  • Transport disruption
  • Government restrictions

8. Live Plant Disclaimer

Planting stock is a living product and natural variations in height, stem diameter, branching and appearance may occur. Such variations do not constitute defects. Avalon Forestry takes all reasonable steps to ensure planting stock is healthy and true to type at the point of dispatch; however, as living organisms, trees and shrubs are subject to natural variation and environmental factors beyond our control.
